Public offer

This offer is addressed to an indefinite number of persons (individuals and legal entities) — visitors of the Website (hereinafter referred to as the Website) of the Public Organisation “Lviv Institute of Military History” (hereinafter referred to as the Institute), hereinafter referred to as the Benefactors, and is an official and public offer of the Institute, represented by its Director Oleh Vasyliovych Feschowetz, acting on the basis of the Institute’s Charter (hereinafter referred to as the Charter), to enter into a charitable donation agreement (hereinafter referred to as the Agreement), the subject and essential terms of which are set forth below.

1. Terms and Definitions:

1.1. Acceptance means full and unconditional acceptance of the public offer by making a money transfer using the payment forms and means posted on the Website as well as by transferring funds to the Institute’s current accounts through banking institutions. The moment of acceptance is the date of transfer of funds to any of the Institute’s current accounts.

1.2. Payment is a voluntary charitable donation (hereinafter referred to as the Donation).

1.3. A Donation is a money transfer made by the Benefactor to achieve the goals, objectives, directions and activities of the Institute in accordance with this Agreement, the Charter, the Law of Ukraine “On Charitable Activities and Charitable Organisations” and the Law of Ukraine “On Public Associations.”

2. Subject Matter of the Agreement:

2.1. The subject matter of this Agreement (hereinafter referred to as the Agreement) is the free transfer of funds by the Benefactor to the Institute to achieve the goals, objectives, directions and types of statutory activities of the Institute.

2.2. Acceptance of the Agreement means that the Benefactor agrees with all its provisions, that he/she is fully aware of the subject matter of the Agreement and the purpose of collecting Donations.

2.3. The Agreement is concluded through the Benefactor’s unconditional and full accession to the Agreement and acceptance of all essential terms of the Agreement.

2.4. The Benefactor and the Institute, guided by Art. 2.3.18–20 of the Charter, Art. 207, Part 2, Art. 639, Art. 641, Art. 642 of the Civil Code of Ukraine, Art. 7 of the Law of Ukraine “On Charitable Activities and Charitable Organisations,” Art. 23 of the Law of Ukraine “On Public Associations,” agree that the Agreement shall be deemed to be concluded in writing without the Parties signing a physical copy from the moment the Benefactor performs the actions stipulated by the Agreement, which indicate the consent to comply with the terms of the Agreement.

2.5. The Agreement shall be posted on the Website (https://www.limi.org.ua) in a freely accessible manner and in a way that ensures that any person applying to the Foundation is familiarised with the content of this Agreement.

2.6. The Benefactor may NOT offer its own terms of the Agreement.

3. Rights and Obligations of the Parties to the Agreement:

3.1 The Institute has the right to:

3.1.1. receive Donations and use them to achieve the goals, objectives, directions and types of statutory activities of the Institute in accordance with the Agreement, the Charter, the Law of Ukraine “On Charitable Activities and Charitable Organisations” and the Law of Ukraine “On Public Associations;”

3.1.2. at the request of the Benefactor, provide a report on the received Donation and its use.

3.2. The Benefactor has the right to:

3.2.1. transfer the Donation to the account of the Institute in the manner specified in the Agreement;

3.2.2. request a report on the use of the Donation.

4. Place and Time of the Donation Collection:

4.1 The collection of voluntary charitable Donations is carried out in any country of the world.

4.2. The collection of Donations continues until the liquidation of the Institute, UNLESS another term is determined by the Institute.

5. Procedure for providing public access to the Institute’s reports:

5.1. The Institute shall publish a report on the activities of the Institute and the use of Donations on its Website.

5.2. The Institute may provide other information in accordance with the procedure and within the terms provided by the legislation of Ukraine.

6. Other terms and conditions:

6.1. The Benefactor independently determines the amount of the Donation.

6.2. All expenses related to the transfer of Donations shall be borne by the Benefactor.

6.3. The Donation is voluntary and non-refundable.

6.4. The Benefactor is responsible for the accuracy of the information provided during the transfer of Donations.

6.5. In order to comply with the Law of Ukraine “On Personal Data Protection” and fulfil the terms of the Agreement, the Benefactor agrees to the processing of his/her personal data.

6.6. The relations between the Benefactor and the Institute shall be governed by the provisions of Ukrainian legislation.
